Terms and conditions of service

1. Preamble

These general conditions of sale (hereinafter also "General Conditions") govern the offer, transmission, purchase methods, acceptance, delivery of the Products purchased and the right of withdrawal of those who made the purchase (hereinafter also the "Customer" ) of the Products, between users of the Site and the seller, while they do not regulate the possible provision of services or the sale of products by different subjects that can be reached through the Site throughhyperlinks, links or banners. The contracts for the sale of the Products will be stipulated between the seller and the Customer and will be concluded exclusively through the internet, through access by the Customer to the Virtual Showcasepublished on the https://rivoire.it/it/2-prodotti Site and the realization of a purchase order according to the procedure provided for in the inside the Virtual Showcase. The contracts concluded between the seller and the customer, where the latter assumes the quality of co-consumer, are governed by Directive 2011/83 / EU of the European Parliament and of the Council of 25/10/2011 and Directive 1999/44 / EC of the European Parliament and of the Council of 25/05/1999. These General Conditions may be subject to changes and updates. Each update and modification will be regularly published on the Virtual Showcase and the date of putting updates online is equivalent to the date of entry into force of the same. In case of changes to the General Conditions, the General Conditions published in the Virtual Showcase at the time the order is sent by the Customer will apply to the purchase order. The user of the Virtual Showcase is invited to read these General Conditions carefully: to this end, the General Conditions are available on the Virtual Showcase to any visitor to the Virtual Showcase itself. The Customer is invited to print or keep these General Conditions in the mannerpreferred. In any case, if the Customer is a consumer (ie a natural person who buys the goods for purposes not related to his professional activity and does not make the purchase by indicating a VAT number, as defined in Article 3, paragraph 1, letter a) of the Consumer Code - hereinafter also the "Consumer" ), once the online purchase procedure has been completed, Rivoire s.r.l. will send links to these conditions of sale that the Customer will print or save and in any case keep, in compliance with the provisions of the current Consumer Code on distance selling.

2. Products

The information relating to the Products for sale through the Virtual Showcase are indicated in the Product Catalog available on the electronic catalogor (Virtual Showcase). The Customer can only purchase the products present in the electronic catalog at the time of placing the order and viewable online at the address (URL) https://rivoire.it/it/2-prodotti as described in detail in the informationsheets. It is understood that the image accompanying the description of a product may not be perfectly and completely representative of its characteristics but differ in color, size, accessory products presented in the figure. All purchase support information is intended as simple generic information material, not referable to the real characteristics of a single product. The Customer may at any time request more informationusing the contacts on the site. Rivoire reserves s.r.l.si right to include additional information and/or special conditions in the information sheets of products and events. The Customer acknowledges and expressly accepts that anyindications contained in the aforementioned information sheets will prevail over these General Conditions. The availability of the Products resulting at the time of the order is purely indicative, since, due to the simultaneous presence within the Virtual Showcase of more users, the Products could be sold to others before the Order Confirmation.

3. Method of purchase and conclusion of the contract.

For the purchase of the Products, theCustomer must completeand send the seller the order form in electronic format, following the instructions contained in the Virtual Showcase. The order form contains a summary of the main commercial conditions, including price, means of payment and delivery methods, as well as summary information on the main characteristics of the Products ordered and reference to the General Conditions. The Customer must enter the Product he wishes to purchase in the appropriate "Shopping Cart" and , after having read the General Conditions, with particular reference to the contribution for delivery costs, the methods of exercising the right of withdrawal, and the Privacy Policy, must select the desired payment method and choose the option"send order". Before sending the purchase order: the Customer can correct any data entry errors, following the appropriate modification procedure contained in the Virtual Showcase. It should be noted that the Customer has the right to modify the quantity and type of Products he intends to purchase, adding or eliminating one or more Products from the "Shopping Cart" the seller will ask the Customer, through the procedure of entering the purchase order, to carefully read the Conditions the Generals, including the right of withdrawal, to print a copy and to store or reproduce a copy for personal use. By sending the order form, the Customer acknowledges and declares to have read all the information provided during the purchase procedure and to fully and unconditionally accept the General Conditions, as well as the additional information contained in the Virtual Showcase and relating to the Privacy Policy. The seller reserves the right to evaluate the acceptance of orders received and may refuse or otherwise not process purchase orders that are incomplete or incorrect, or in case of unavailability of the Products or that involve the delivery of the Products ordered in some geographical arease. à to accept orders received within 48 hours from the working day following that on which the Customer sent the order and will refund any sums already paid by the Customer for the payment of the supply. Without prejudice to the reimbursement of all sums paid by the Customer, the Customer's right to obtain the payment of any other sum for any reason (indemnity, compensation, etc.) is excluded; any contractual or non-contractual liability for direct or indirect damages to persons and/or things, possibly attributable to the non-acceptance by Rivoire s.r.l., even partial, of an order is also excluded. The contract of sale of the Products indicated in the order form will be considered concluded with the sending by the seller to the Customer of an order confirmation e-mail (hereinafter the "Order Confirmation") to the email address electronic communication by the Customer. This confirmation will summarize the selected Products, the relative prices, VAT and any taxes due, transport and delivery costs, delivery address, order number (hereinafter "Order Number") and the General and particular Conditions applicable to the Order. The Order Number, generated by the system and communicated by the seller, must be used by the Customer in any subsequent communication with the seller. The Customer undertakes to verify the correctness of the data contained in the order confirmation and to promptly notify Rivoire s.r.l. of any corrections, according to the methods described in this document.

4. Prices

All prices of the Products indicated in the electronic catalog are inclusive of VAT and taxes. Delivery costs (hereinafter "Delivery Costs") are charged to the Customer and adequately highlighted in the order and in the Order Confirmation. In particular, in the order form, in the Order Confirmation and in the relative receipt / invoice will be reported in detail: - the price of the Product - VAT and any other taxes, if due; - Delivery Costs. The prices published in the electronic catalog / Virtual Showcase and the offers may vary; the seller reserves the right to make changes without notice. The price indicated on the Virtual Showcase at the time of sending the order form applies to the Products; any previous offers or price changes madesubsequently cannot be taken into consideration. In the event that a price has been published incorrectly by mistake, the seller reserves the right not to confirm the order received, waiving the sale, in the exercise of the right provided for in point 3.

5.Payment

The payment methods are those indicated in the order form. In particular, payment can be made online by credit or debit card among those recognized and authorized by Rivoire s.r.l., PayPal and with any other methods specified in the Virtual Showcase and in the "Shopping Cart" section. All financial information necessary for the transaction will be transmitted, via encrypted protocol, to the payment management system, which provides the related remote electronic payment services, without third parties having access to them. This information will never be used by the seller except to complete the procedures relating to the purchase and to issue the relative refunds in favor of the Customer in case of any returns of the Products, following the exercise of the right of withdrawal, or if it is necessary to prevent or report to the police the commission of fraud on the Virtual Showcase and / or on the Site. For reasons of security of transactions, the seller reserves the right to request the sending of a copy of an identity document of the holder of the credit card or PayPal account, as well as further information (fixed telephone number; copy of household utility bill; etc.). At the same time as the communication of the Order Confirmation, the amount corresponding to the Products purchased will be charged to the Customer. The seller will issue the purchase receiptof the Products, sending it by e-mail to the order holder within 48 (forty-eight) hours from the Order Confirmation. For the issuance of the receipt, the information provided by the Customer will prevail. No change in the data will bepossible after the receipt has been issued. In case of cancellation of the order in case of non-acceptance of the same by Rivoire s.r.l., Rivoire s.r.l. will request the cancellation of the transaction and the release of the amount committed. The release times, for some types of cards, depend exclusively on the banking system and can reach their natural expiry (24th day from the date of authorization). Once the transaction has been cancelled, the Customer acknowledges and expressly accepts that under no circumstances can Rivoire s.r.l. be held liable for any damages, direct or indirect, caused by delay in the failure to release the amount committed by the banking system. If the payment was made by PayPal account, the re-crediting times on the chosen payment instrument within the PayPal account will depend exclusively on PayPal and the banking system. Once the amount has been credited back to the PayPal account, in no case can Rivoire s.r.l. be held responsible for any damages, direct or indirect, caused by delays in the actual crediting dependent on PayPal or the banking system.

6. Delivery methods

The Products purchased will be delivered to the address indicated by the Customer in the order form. Delivery Costs are charged to the Customer and are clearly shown on the e-shop, in the order form and in the Order Confirmation. Their value also depends on the total amount of the individual order. The shipment of the Products will take place only after the payment of the full amount of the order (including the price of the Products purchased, VAT and any taxes, if due, and Delivery Costs) has been regularly made by the Customer. Rivoire s.r.l. guarantees the shipment of all products on the Italian national territory and in the countries of the European community.  The standard shipping method provides home delivery, alternatively there is the method of collection in store without shipping costs. Depending on the choice of shipping method, in case of withdrawal, Rivoire s.r.l. will refund the amount of the goods while the return costs will be borne by the customer except for defects attributable to Rivoire s.r.l.. Any delivery terms shown on the Virtual Showcase are purely indicative and non-binding. Any variant to the above will be promptly communicated by e-mail to the Customer. At the time of delivery, the presence of the Customer or a trusted person is required to check that the packaging is intact and clean and that the Products received correspond to what is reported on the Order Confirmation. In case of visible defects, such as incorrect quantities and / or incorrect Product and the non-integrity of the packaging, the Customer or the person in charge of his trust, must provide for the relative report on the transport document and contact the Customer Care of the seller at the e-mail address ordini@rivoire.it no later than 8 (eight) days from the Delivery. In any case, the guarantees provided for by Directive 1999/44/EC and subsequent provisions are reserved. Mod. and integr.  The products purchased may remain in storage at the carrier according to the contractual methods, in case of failure to terminate after the second notice the products will be returned to Rivoire s.r.l. which will refund the Customer the value of the order without prejudice to the price paid for perishable goods and withholding the Delivery Costs and those incurred for returning the Products to the seller. No responsibility can be attributed to Rivoire s.r.l. in case of delay in the order or delivery of the order.

7. Right of withdrawal.

Pursuant to Article 59 of the Consumer Code (Legislative Decree 2005/206), the right of withdrawal does not apply, among others, to contracts for the supply of food, beverages or other goods for domestic use for current consumption supplied to the consumer's home, place of residence or place of work, as well as goods that are likely to deteriorate or expire quickly and those personalized. For the sole event that the Customer can exercise the right of withdrawal pursuant to Articles. 52 et seq. of the Consumer Code, the following discipline will apply. The Customer, as a consumer, has the right to withdraw from the purchase of the Products without any penalty and without specifying the reason, within 14 days. The withdrawal period expires after 14 days from the day on which the customer or athird party, other than the carrier and designated by the customer, acquires physical possession of the last good ordered. In the case of a contract relating to multiple goods ordered by the customer in a single order and delivered separately, the period of 14 days starts from the day on which the customer or a third party, other than the carrier designated by the latter, acquires physical possession of the last good. To exercise the right of withdrawal, it is necessary to inform the Customer Care of Rivoire s.r.l. of the decision to withdraw from the contract through any explicit declaration to that effect (for example by registered letter with return receipt, fax or e-mail). To this end, it is possible, but not mandatory, to use the standard withdrawal text whose content is described below. If the Customer decides not to use the standard text of withdrawal, he must submit any other explicit declaration of his decision to withdraw from the contract. Once this declaration has been made, the Customer will receive feedback from the Customer Care of Rivoire s.r.l. indicating the methodsto be used for returning the Product(s). Upon receipt of the aforementioned communication, the Customer must return to the address and within the terms  indicated, and in any case within 14 days from the date on which he communicated the withdrawal, the Products for which he has exercised the right of withdrawal. In accordance with the law, the shipping costs related to the return of the goods are charged to the customer. Thematerial must be returned intact, in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc.), complete with the attached tax documentation and the return is the full responsibility of the customer. Without prejudice to the right to verify compliance with the above and provided that the exercise of the right of withdrawal takes place within the terms indicated above, Rivoire s.r.l. will refund the amount of the Products subject to withdrawal as soon as possible and in any case within a maximum period of 14 days from receipt of the Customer's notice of withdrawal. AND However, the seller has the right to withhold the refund until he has received the Products subject to withdrawal or until the Customer has demonstrated that he has returned the Products subject to withdrawal, whichever occurs first. It is reiterated that the right of withdrawal provided above does not apply with reference to products made to measure or clearly personalized or which, by their nature, cannot be returned or are likely to deteriorate or expire rapidly, or that do not lend themselves to being returned for hygienic reasons or related to protection health and were opened after delivery; or which, after delivery, are, by their nature, inseparably mixed with other goods. In any event, the consumer shall be liable for any diminished value of the goods resulting from handling of the goods other than that necessary to establish the nature, characteristics and functioning of the goods. Without prejudice to the possibility for the Customer to exercise the right of withdrawal by communicating to the Customer Care of Rivoire s.r.l. any otherexplicit declaration of his decision to withdraw from the contract, he may use the following standard text: "I/we (*) hereby notify the withdrawal from my/our (*) contract concluded for the purchase of the following goods/services (*) – ordered on (*) / received on (*) – name of buyer(s) – address of buyer(s) – date. "

8. Purchase as a professional or business

If the purchase is made by a professional, it will be possible to request the issuance of the invoice by flagging the "request invoice" box in the cart and filling in the appropriate fields provided, before proceeding with the payment. The professional is responsible for the correct insertion of billing data and is expressly informedthat, in case of failure to request the invoice according to the methodsmentioned above, it will not be possible to request it later. If you opt for this modeit is necessary to remember that the professional is no longerconsidered as a Consumer, and thereforewill not be able to benefit from the rights reserved to consumers by the applicable legislation.

9. Intellectual and industrial property rights

Rivoire s.r.l. informs that the Site, as well as all trademarks and distinctive signs used by Rivoire s.r.l. in relation to the sale of products, is protected by applicable intellectual and industrial property rights and that any type of reproduction, communication, distribution, publication, alteration or transformation, in any form and for any kind of is prohibited. The purpose of the site is the contents of the site, trademarks and distinctive signs used by Rivoire s.r.l. (such as, by way of example, works, images, photographs, drawings, dialogues, presentations, music, sounds, videos, graphics, colors, functionalityand design of the site). Rivoire s.r.l. assumes no responsibilityfor trademarks and other distinctive signs that appear on the products it sells on the Site, with respect to which the Customer does not haveany rights following the conclusion of the contract.

10. Processing of personal data

Rivoire s.r.l. processes customer data and its Customer Care service in accordance with the provisions of the legislation on the protection of personal data, as specified in the information provided pursuant to art. 13 of European Regulation no. 679/2016 (GDPR).

11. Information and Complaints

Any complaint must be addressed to Rivoire s.r.l. by registered letter with return receipt. or PEC at rivoire.firenze@pec.it.

12. Applicable law and jurisdiction

The sales contract between the Customer and Rivoire s.r.l. is concluded in Italy and governed by Italian law. For the solution of any dispute arising from the conclusion of this distance sales contract, if the Customer is a consumer, the territorial jurisdiction is that of the reference court of his municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Florence, with the exclusion of competing or alternative courts.
